1. ABOUT US
Retro Cactus Furniture is the trading name of Ben Tinker, a sole trader. In these terms, “Retro Cactus Furniture”, “we”, “us” and “our” refer to that business.
Retro Cactus Furniture is a Derbyshire-based specialist in professionally refinished Ercol, vintage and mid-century furniture, with UK-wide delivery and a separate furniture collection and delivery service.

2. WHEN THESE TERMS APPLY
These terms apply to furniture and related goods bought from us through our website or agreed directly with us by email, telephone, WhatsApp, invoice or another written method.
Our separate Returns & Refunds Policy, Delivery & Collection Terms and Privacy & Cookie Policy also apply and form part of these terms where relevant.
If you buy through a third-party marketplace, that marketplace’s terms may also apply to the sale and payment. Where we provide the delivery ourselves, our Delivery & Collection Terms will apply to that delivery unless the marketplace terms require otherwise.
Some sections of these terms apply differently depending on whether you are a consumer or a business customer. A consumer is an individual buying mainly for personal use. A business customer is anyone buying mainly for a trade, business, craft or profession.
3. VINTAGE AND REFINISHED FURNITURE
Most of our furniture is vintage, pre-owned and one of a kind. Its age, history and previous use form part of its character. We describe each item as accurately as reasonably possible and use photographs to show its appearance and condition.
The condition expected of vintage furniture is not the same as that expected of a newly manufactured item. Age, price, description, disclosed marks, repairs, refinishing and photographs will all be relevant when assessing its condition. This does not affect a consumer’s legal right to receive goods that are satisfactory taking account of those factors, fit for any purpose made known to us and as described.
Measurements are approximate and small variations may occur. Colours, wood tones and finishes can also appear different because of lighting, photography and screen settings. Customers should ask before buying if a particular measurement, colour or feature is essential.
Where an item has moving, removable or extending parts, the photographs may show only some possible arrangements. Accessories or decorative objects shown in photographs are not included unless the listing says that they are.
4. AVAILABILITY AND ONE-OFF ITEMS
Our furniture may be advertised on our website and on third-party marketplaces at the same time. Because most pieces are one-off items, an item can occasionally sell elsewhere before every listing updates.
Displaying an item on our website does not guarantee that it is still available and is not, by itself, our acceptance of an order.
5. ORDERS AND FORMATION OF THE CONTRACT
When you place an order, you are offering to buy the item on these terms. An automatic order or payment acknowledgement confirms that we have received the order; it does not necessarily mean that we have accepted it.
A contract is formed when we send written confirmation that we have accepted the order, or when we otherwise clearly confirm acceptance in writing.
Before acceptance, we may decline or cancel an order and refund any payment if:
- the item has already sold;
- stock or listing information is incorrect;
- there is an obvious pricing or description error;
- we cannot safely or reasonably deliver to the address supplied; or
- we have another legitimate reason for being unable to fulfil the order.
We will contact you using the details supplied with the order. If we cancel after taking payment, we will return the payment using the original payment method unless another method is agreed.
6. PRICES, DELIVERY CHARGES AND PAYMENT
Prices are shown in pounds sterling. Retro Cactus Furniture is not VAT registered, so VAT is not added to our prices.
Delivery is charged separately unless the listing or written quotation says that it is included. Delivery charges may be fixed or quoted individually according to distance, access, size, weight, route and the space required in the vehicle.
We accept:
- debit and credit card payments through Wix;
- PayPal;
- bank transfer; and
- cash on collection or on personal delivery within the UK, where agreed in advance.
For ordinary in-stock furniture delivered personally by us, the balance may be paid before delivery or on delivery, as agreed. If a third-party carrier is used, the balance must be paid before dispatch. Overseas orders must be paid in full before dispatch or delivery.
Deposits and reservation arrangements are agreed case by case. The amount, payment date, purpose and any cancellation consequences will be confirmed in writing. Unless agreed otherwise, ownership of goods does not pass to the customer until we have received the full purchase price.
7. FURNITURE AWAITING REFINISHING OR CUSTOMISED WORK
We sometimes sell furniture before refinishing is complete. We may also agree a particular finish, colour or other customer choice.
The agreed work, finish, price and any material customer choices should be recorded in writing. Natural variations in vintage timber, grain, colour and the way an existing surface responds to refinishing mean that an exact match to a photograph or sample cannot always be guaranteed. We will carry out the agreed work with reasonable care and skill.
For custom or non-standard work, the outstanding balance must normally be paid before delivery or collection.
The statutory right to cancel a distance sale may not apply to goods made to a customer’s specifications or clearly personalised, including furniture refinished to a genuinely individual specification. We will tell the customer before the contract is made where we consider this exception to apply.
This exception does not remove legal rights if the item is faulty, not as described or the agreed service has not been carried out with reasonable care and skill.
8. DELIVERY AND CUSTOMER COLLECTION
Furniture may be:
- delivered personally by us;
- delivered by a third-party carrier; or
- collected by the customer from our unit by appointment.
Delivery dates, access responsibilities, dismantling, fragile items, customer collections, standalone transport jobs and storage are covered by our Delivery & Collection Terms.
Unless a different period is agreed, consumer orders will be delivered without undue delay and within 30 days after the contract is made. Most furniture deliveries are individually planned, so the agreed route or delivery date will normally replace that default period.
For consumer sales, the goods remain at our risk until they come into the physical possession of the consumer or a person identified by the consumer, except where the consumer independently appoints a carrier that we did not offer.
9. CANCELLATIONS, RETURNS AND REFUNDS
Consumer cancellation rights, return costs, faulty goods and refund times are explained in our Returns & Refunds Policy.
Nothing in these terms limits a consumer’s statutory rights. Requests should preferably be made in writing by email or WhatsApp so that both parties have a record.
10. INSPECTION AND REPORTED PROBLEMS
Customers should inspect furniture as soon as reasonably possible after delivery or collection. If there is visible transit damage, please photograph the furniture and any packaging and contact us promptly.
This helps us investigate with the carrier and does not remove or shorten any statutory right.
A customer should not arrange a repair, disposal or return at our expense without first giving us a reasonable opportunity to inspect the issue and agree an appropriate solution, unless urgent action is reasonably necessary to prevent further damage or danger.
11. INTELLECTUAL PROPERTY
Unless stated otherwise, the photographs, product descriptions, written content, graphics, branding, page designs and other original material on our website and sales listings belong to Retro Cactus Furniture or are used with permission.
They must not be copied, downloaded for reuse, edited, reproduced, republished, sold, licensed, distributed, used in another sales listing or used commercially without our prior written permission.
This includes removing objects or branding from our photographs, creating edited versions and presenting our images as photographs of another seller’s furniture.
You may share an ordinary link to a public page or listing. Nothing in this section restricts use that is expressly allowed by law.
12. WEBSITE USE AND THIRD-PARTY LINKS
We try to keep the website accurate and available, but we do not guarantee uninterrupted access or that every page will always be free from errors. We may update, remove or correct website content where reasonably necessary.
Links to third-party websites are provided for convenience. We are not responsible for third-party content, services or privacy practices. A purchase made through a third-party marketplace may be governed by that marketplace’s separate terms.
13. OUR RESPONSIBILITY TO CONSUMERS
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was made.
We supply goods to consumers for private use. We are not responsible for business losses, loss of profit, loss of revenue or loss of business opportunity arising from a consumer purchase.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer’s statutory rights relating to faulty or misdescribed goods.
14. BUSINESS CUSTOMERS
If you are buying wholly or mainly for business purposes, you confirm that you have authority to bind the business and that the consumer-only rights described in these policies do not apply.
For business customers, all terms implied by law are excluded to the fullest extent permitted by law. Subject to liabilities that cannot legally be limited, our total liability arising from a business order will not exceed the total amount paid or payable for the goods or service giving rise to the claim.
We will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of contracts, loss of goodwill or business interruption.
15. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay caused by events outside our reasonable control, such as severe weather, road closures, ferry disruption, vehicle breakdown, accident, illness, industrial action or a third-party carrier failure.
We will contact the customer as soon as reasonably possible and take reasonable steps to minimise the delay. This does not affect any right the customer has to end the contract where the law allows.
16. PERSONAL INFORMATION
We process personal information as described in our Privacy & Cookie Policy.
17. CHANGES TO THESE TERMS
We may update these terms when our services, website or legal obligations change. The version that applies to an order is normally the version provided or available when the contract is made, unless a later change is required by law or is expressly agreed.
18. GOVERNING LAW AND DISPUTES
These terms are governed by the law of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections and may bring proceedings in the courts that apply where you live. Business customers agree that the courts of England and Wales will have exclusive jurisdiction.
